Mufti issues fatwa on judgment, arrested

Police on Thursday arrested Khargone district Darul-uloom-mufti (leading Islamic school of jurisprudence) Mohammad Rafiq Qasim for allegedly issuing a fatwa in a divorce decree by a Sendhwa court on the ground that the judge was a 'non-Muslim'.

The mufti said since the judge was a non-Muslim, the judgment was not acceptable under the Islamic law.

Qasim was produced before Chief Judicial Magistrate S R Bamania who released him on a bail on a bond of Rs 10,000.

The case was registered on Wednesday in Khargone against the mufti who had issued a fatwa in Arjumand Bano case in which the latter has obtained a divorce decree against her husband from the Sendhwa court and got remarried to a schoolteacher.

However, her husband approached Daurul-uloom-mufti who issued the fatwa. Arjumand's first husband also claimed that her second marriage was illegal, since as per Shariat she continues to be his wife.

Meanwhile, the Vishwa Hindu Parishad protested against the fatwa and demanded stern action against the mufti.
