A special court on Tuesday declined to hear the bail application of Rajesh Talwar, key accused in the Noida twin murder case, on the ground that it was not empowered to take up the plea.

Special Magistrate for Central Bureau of Investigation's cases Sapna Mishra observed that the sessions court was competent to take up the bail matter of Talwar, who is at present in judicial custody.

Counsel for Talwar Satish Tamta said that the defence will move the Sessions Court soon for his bail and also plead for an early hearing.

Talwar was arrested by the Noida police, on May 23, which claimed that he had murdered his daughter Aarushi and domestic help Hemraj after finding them in an 'objectionable position'.

However, with the Noida police being accused of improper investigation, the case was transferred to the CBI, which began its probe on June 1. The CBI also questioned Talwar after taking his remand from court.
